Terms of Service
Welcome to TalentSymbia. By accessing or using our platform you agree to these Terms. Please read them carefully. If you do not agree, do not use the service.
1. General Terms
TalentSymbia ("Platform", "we", "us", "the Service") provides AI career intelligence tools and a peer-to-peer skills marketplace. These Terms govern your use of all Platform features including career analysis, profile pages, marketplace listings, messaging, payments, and the AI Career Navigator.
The Service is operated by Atanas Georgiev Markov as a sole proprietor based in Burgas, Bulgaria. By registering, you confirm you are legally allowed to enter binding agreements.
You must be at least 18 years old to use TalentSymbia.
2. Beta Notice
- Payment processing currently runs in sandbox/test mode — no real money is charged
- Features may change, break, or be removed without notice
- Some advertised features may still be in development
- Token purchases are limited to invited beta testers; all registered users receive 100 free tokens at signup
- Accounts and listings created during beta will carry over to public launch
Use of the Service during beta is at your own discretion. We welcome feedback at support@talentsymbia.com.
3. Accounts & Registration
You can create an account using email and password, or via Google Sign-In. You are responsible for maintaining the security of your credentials and for all activity under your account.
- One account per person — multiple accounts are not permitted
- You may not impersonate others or provide false information
- Email verification is required for marketplace features
- You must notify us immediately at support@talentsymbia.com if you suspect unauthorized access
You can request account deletion at any time by emailing us. Some data may be retained for legal compliance — see our Privacy Policy for details.
4. Description of Service
TalentSymbia combines:
- A marketplace where users offer and request services (freelance work, mentorship, consulting, etc.)
- An AI Career Navigator powered by Anthropic Claude and Google Gemini for career analysis and matching
- A token economy for unlocking premium features
- A messaging system for user-to-user communication
We are an intermediary — we facilitate connections between users but are not party to service agreements between them.
5. Marketplace Rules
All marketplace listings must be legal and comply with our content policies.
- No illegal goods or services
- No misleading descriptions
- Sellers are responsible for delivering what is described
- Buyers are responsible for clearly communicating their requirements
- Listings expire after 30 days and may be extended with tokens
- We do not verify the qualifications, identity, or quality of services offered (except where a "verified" badge is explicitly shown)
- Sell only your own work. Sellers may offer services they personally perform and digital work they created themselves. Reselling other people's goods or services and dropshipping are prohibited. When physical product categories open in the future, the same rule will apply: goods you made yourself or works you authored.
Hiring listings
Users may post listings indicating that they are hiring or looking for work. TalentSymbia only hosts these listings and enables direct contact between users. We are not an employment agency or recruitment intermediary: we do not mediate, negotiate, or participate in employment relationships, and we do not charge placement or recruitment fees. Any employment or engagement contract is concluded directly between the parties, outside the Platform.
6. Tokens & Subscriptions
Tokens are an in-Service currency used to unlock features (boosted listings, premium AI runs, featured profile placement). Tokens have no cash value outside the Service.
Earning and using tokens
- New users receive 100 free tokens at signup
- Tokens may be earned through Service activities (daily check-ins, completed deals)
- Tokens can be purchased — currently limited to invited beta testers via PayPal Sandbox
Subscriptions
We offer paid subscription plans with additional features. Subscriptions are billed in advance and renew automatically until cancelled. You can cancel at any time from your account settings or by emailing us.
Changes to the token system
We may modify, suspend, or discontinue the token system, token pricing, features unlocked by tokens, or earning mechanisms at any time. We will provide reasonable notice (at least 14 days by email) for material changes affecting paid users.
EU 14-day right of withdrawal
Under EU consumer law, you have a 14-day right of withdrawal for digital subscriptions, unless you have already used the Service in a way that consumes the value (e.g., used purchased tokens for AI analyses).
- Unused tokens: refundable within 14 days of purchase
- Used tokens: not refundable (consumed)
- Subscriptions: refundable within 14 days if not yet used; pro-rated refunds at our reasonable discretion afterwards
To request a refund, email support@talentsymbia.com with your transaction ID.
7. Payments & Platform Fee
Marketplace deal payments are processed via Trustap, a regulated third-party escrow provider (Trustap Ltd, Ireland). Token purchases and subscriptions are processed via PayPal. TalentSymbia charges a 10% platform fee on all completed deals, deducted before funds are paid out to the seller.
In addition to our platform fee, Trustap charges its own transaction fee, and an international transaction fee may apply when the buyer and seller are located in different countries. All applicable fees and the total amount are displayed to you before you pay.
All prices are in EUR unless otherwise stated. To receive payouts, sellers must complete Trustap registration, including identity verification (KYC) — see Section 8. By entering an escrowed deal you also agree to Trustap's Terms of Service; by purchasing tokens or subscriptions you agree to PayPal's terms.
During the beta period, all payments run in sandbox/test mode (PayPal Sandbox and the Trustap sandbox environment) — no real charges occur. Live payments will be activated when the Service exits beta.
8. Escrow & Deal Flow
When a seller accepts a deal, an escrow transaction is created with Trustap and the buyer pays through Trustap's secure hosted payment page. Trustap holds the funds while the work is performed. This protects both parties:
- Buyer: funds are held in escrow by Trustap and only released after the work is confirmed complete and the buyer-protection (complaint) period has passed
- Seller: the buyer's payment is secured in escrow before you start working
When the work is confirmed complete, a buyer-protection period opens, during which the buyer may raise a formal complaint with Trustap (see Section 9). The deadline for this period is shown on your deal page. After the period ends — and any complaint is resolved — funds are released to the seller, less the fees described in Section 7.
To withdraw funds, sellers complete Trustap's registration and identity verification (KYC). We prompt sellers to start this when they accept their first paid deal, so verification can run in parallel with the work.
9. Disputes & Refunds
For escrowed deals, formal disputes are handled by Trustap — not by TalentSymbia. Trustap holds the funds and operates the dispute process under its Disputes and Refunds Policy. Possible outcomes (refund to the buyer, release to the seller, or a split) are determined through Trustap's process.
- How to raise a dispute: use the "Raise a dispute" action on your deal page, or contact Trustap directly — within the buyer-protection period shown on your deal. Complaints raised after the period ends cannot pause the release of funds.
- TalentSymbia messaging is not a formal dispute channel. A complaint written only in chat does not open a dispute and does not stop funds from being released. Always use the dispute action.
- Your conversation history is evidence. Messages exchanged on TalentSymbia may serve as a record of what was agreed, and Trustap may request them during a dispute investigation.
TalentSymbia remains neutral and does not adjudicate escrowed funds. We may provide information (such as conversation records) to Trustap's dispute process where appropriate, but we do not decide outcomes and are not liable for losses arising from user disputes beyond amounts held by our payment partners.
For issues that do not involve escrowed payments — such as conduct, content, or account problems — contact us at support@talentsymbia.com.
EU consumers retain the right to use the EU Online Dispute Resolution platform — see Section 17.
10. AI Features & Limitations
Your prompts, resumes, and conversations are sent to Anthropic Claude and/or Google Gemini for processing on our behalf under their data processing agreements. See our Privacy Policy for details.
We instruct AI providers (Anthropic, Google) to process your data only for the purpose of providing AI features within our Service. To the extent permitted by law, we are not responsible for how third-party AI providers process data beyond our instructions, including their internal model improvements, research uses, or any breach of their contractual obligations to us.
We do not guarantee the accuracy, completeness, or usefulness of AI output. Use it as one input among many — not as professional advice.
11. Conduct & Content
You agree not to:
- Harass, threaten, bully, or abuse other users
- Post false, misleading, or defamatory content
- Attempt to circumvent platform fees by transacting off-platform
- Use automated tools to scrape data or attempt to bypass rate limits
- Attempt unauthorized access to the platform or other user accounts
- Transmit malware, conduct phishing, or attack our systems
- Create fake listings, fake reviews, or manipulate matching/ranking
- Engage in money laundering, fraud, or sanctioned-party transactions
We reserve the right to remove content and suspend users who violate these rules at our reasonable discretion. For severe violations, we may report illegal activity to authorities.
12. Intellectual Property
Our IP: The TalentSymbia name, logo, design, code, and platform features are owned by us. You may not copy, modify, or redistribute them without permission.
Your IP: You retain ownership of content you upload (listings, portfolio items, messages, profile info). By posting, you grant us a non-exclusive, worldwide license to display, distribute, and use it as needed to operate the Service.
Reporting infringement: If you believe content on TalentSymbia infringes your rights, email support@talentsymbia.com with description of the work, location of infringing content, and your contact information.
13. Privacy
We collect the minimum data necessary to operate the platform: account info, profile data, transaction data, IP addresses (for security), and AI conversation history. We do not sell your personal data to third parties.
For full details on what we collect, why, who we share it with, and your GDPR rights, see our Privacy Policy.
14. Suspension & Termination
We may warn, suspend, or terminate your account if you violate these Terms, your activity is harmful to other users, or we are required to do so by law. Where reasonable, we will give notice before termination.
Effect of termination:
- Your access to the Service ends
- Active listings are removed
- Unused tokens may be forfeited only in cases of serious or repeated violations of these Terms. Minor or first-time violations will not result in token forfeiture without prior warning.
- Some data may be retained for legal compliance (see Privacy Policy)
You can stop using the Service or delete your account at any time by emailing support@talentsymbia.com.
15. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded under Bulgarian and EU consumer law.
To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or €50, whichever is greater.
We are not liable for: indirect or consequential losses, the quality of services delivered by marketplace sellers, AI analysis accuracy, third-party service outages (PayPal, Cloudinary, Google, Anthropic, etc.), or losses arising from disputes between users.
These limits do not apply to: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or other liability that cannot be limited under Bulgarian or EU law. Nothing in these Terms limits your rights as a consumer under mandatory EU law.
16. Changes to These Terms
We may update these Terms as the Service evolves. When we make material changes:
- We will update the "Last updated" date at the top of this page
- We will notify active users by email at least 14 days before changes take effect
- You may close your account if you disagree with changes
- Continued use after changes take effect constitutes acceptance
17. Governing Law & Disputes
These Terms are governed by the laws of Bulgaria and applicable EU regulations.
If a dispute arises:
- First, contact us at support@talentsymbia.com — we will try to resolve issues informally and quickly.
- EU consumers may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
- If informal resolution fails, disputes will be resolved by the competent courts of Bulgaria, except where mandatory consumer protection law gives you the right to file in your country of residence.
